So, you have a weapon registered in the prescribed manner. However, this does not mean that it can now be used in drunken fights, conflicts on the roads and other “convenient” cases. The main task of civilian self-defense weapons is to protect life, health and property only in a state of emergency or necessary self-defense . Similar restrictions are enshrined in Art. 24 Federal Law “On Weapons” (hereinafter referred to as the Law). A rude word spoken to you, the theft of cucumbers from your summer cottage, or the burning of a newspaper in your mailbox are not grounds for the use of weapons. That is, all those cases when there is a direct threat.

Also, certain restrictions are imposed by law on persons against whom weapons can be used. The use of weapons in relation to:

  • disabled people;
  • women;
  • minors, if their age is obvious to the defender.

The exception is cases of armed or group attack by persons of this category.
That is, you have the right to use a weapon if, for example, a crowd of teenagers beats you on the street or some disabled person decides to practice the “running boar” shooting exercise on you with a hunting rifle. The process of using weapons

Stage 1. Warning. An American proverb says: “When you get a gun, shoot.” In our country, before using it, the criminal should be clearly warned about it. So decide for yourself whether it’s worth wasting time on a warning or whether it’s better to shoot without delay. In the latter case, you may then have problems with the police in the form of a criminal case and deprivation of your license, you may be imprisoned, but, as they say, it is better to be in prison badly than to be in the morgue well.

Stage 2. Shooting at the target. According to the law, our criminal is a gentle creature and should be treated with the utmost caution. On any pack of traumatic cartridges you will find a warning that it is forbidden to shoot at a person at a distance of less than one meter, as well as at his head. Where to shoot? It all depends on the amount of clothing the attacker is wearing. In winter, when even criminals are dressed in warm clothes, shooting at the body is ineffective, and since it is impossible to hit the head, only the legs and unprotected parts of the arms remain. In the summer, the task is significantly simplified - you can choose any part of the body except the head and, perhaps, the groin. In a word, your task is not to kill the enemy at any cost, but to disable him for a certain time. Attempts to deprive the offender of his life will already be qualified as exceeding the limits of necessary defense.

Stage 3. We report the incident to the authorities. You must immediately (no later than 24 hours) report each case of the use of weapons to the nearest police department (Article 24 of the Law). While the police are on their way, if possible, we do the following:

  • if the attacker escaped, we remember his signs, but if he is wounded and unable to move, we call an ambulance;
  • We photograph or film the scene of the incident;
  • if there are witnesses, even at gunpoint, we do not let them run away until the police arrive;
  • we warn relatives about the incident, it is advisable that one of them drive up to the scene of the incident as quickly as possible;
  • we do not touch the cartridges and, in particular, the attacker’s weapon, if he had one.

Stage 4. The most difficult.
The difficulty of this stage is to avoid becoming a criminal yourself. If you think that the police will be kind and benevolent to you, then you are mistaken. Let’s face it, it’s very easy for our law enforcement agencies to open a case that has everything that is needed for an article: a criminal (you), a weapon, a victim (the attacker), and it won’t amount to an article for causing harm to health by exceeding the limits of necessary defense. special work. It is much more difficult to establish the criminal intent of the attacker in the absence of witnesses, as well as the hopelessness of your situation. Thus, in order not to “drown” yourself with your own hands, you must:

  • Write the first explanations correctly. “Friendly” advice from operatives, like, let’s write it our way, nothing will happen to you for it, should be ignored. It is important that you are able to write your explanations in your own hand. If an operative writes explanations based on your words and then asks you to sign them, do this only after carefully reading them. Record all comments in the same document. You do not need to obtain permission from anyone to do this. In your explanation, clearly indicate all the circumstances of what happened: the moment of the attack, what the threat was to life and health, the validity of the weapon being in your possession, your actions to prevent the attacker, the direction of the shots, the result achieved, your actions after repelling the attack (calling the police, ambulance, etc.). d.), information from witnesses, if any.
  • Find a good lawyer. The Soviet thesis that an honest person has nothing to fear and does not need a lawyer is no longer relevant today. After giving initial explanations, not a single visit to the police should be done without a lawyer; you do not know all the intricacies of the investigator’s work, but your lawyer does. Responsibility for the unlawful use of self-defense weapons

  • Art. 114 “Causing grievous or moderate harm to health by exceeding the limits of necessary defense or by exceeding the measures necessary to detain the person who committed the crime”;
  • Art. 213 “Hooliganism.”

Civil
In this case, we are talking not about liability for the illegal use of weapons, but for the consequences of such use, expressed in the harm caused to the victim (material or moral). According to Art. 1064 of the Civil Code of the Russian Federation, damage is compensated by the person who caused it. At the same time, damage caused within the limits of necessary self-defense and extreme necessity (Article 1066 and Article 1067 of the Civil Code of the Russian Federation), subject to the limits of self-defense, is not compensated. In addition, it is necessary to keep in mind that in accordance with Part 1 of Art. 1083 of the Civil Code of the Russian Federation, harm resulting from the intent of the victim is not subject to compensation. Thus, if the investigation manages to prove the unlawfulness of the attacker’s act, which provoked you to use a weapon, the issue of compensation for the harm caused to him will be decided in your favor.

If, as a result of your unlawful use of a weapon, the victim suffered harm to his health, then he will be compensated in the form of compensation for the earnings that he had or could have had during the period of restoration of health. In addition, expenses for treatment, additional food, purchase of medicines, prosthetics, outside care, sanatorium treatment, purchase of special vehicles, preparation for another profession are recovered, if it is established that the victim needs these types of help and care and does not have the right to receive them free of charge (Article 1085 of the Civil Code of the Russian Federation).

In the event of the death of the victim, claims from relatives and dependents are possible demanding compensation for damage in connection with the death of the breadwinner (Article 1088 of the Civil Code of the Russian Federation), as well as expenses for the burial of the deceased (Article 1094 of the Civil Code of the Russian Federation). However, not all relatives can claim compensation for harm. These could be:

  • disabled persons who were dependent on the deceased or who had the right to receive maintenance from him on the day of his death;
  • a child of the deceased born after his death;
  • one of the parents, spouse or other family member who is caring for dependent relatives of the deceased (children, grandchildren, brothers and sisters) who have not reached 14 years of age, or who have reached the specified age, but need outside care for health reasons;
  • persons who were dependent on the deceased and became disabled within 5 years after his death.

Compensation for harm caused by injury to health or death of the victim is made in monthly payments (Article 1092 of the Civil Code of the Russian Federation).
Among other things, do not forget about compensation for moral damage, which can be recovered simultaneously with the above requirements. Its size depends on the strength of the victim’s evidence.

To summarize all that has been said, I would like to once again remind you of one simple truth: before using a weapon, think about whether it is worth it or not. Anyone who thinks that weapons, especially traumatic ones, provides absolute protection is mistaken. In the wrong hands, it can turn against its owner, and the consequences of this can be disappointing.

Gun power

This indicator can only be considered in relation to traumatic weapons or PCP air pistols. For traumatic weapons, the legislation introduced a limit of 91 J; higher energy can only be allowed in service weapons, for example, the “Shaman” pistol has a muzzle energy of 120 J.

There is a large amount of ammunition for self-defense weapons on the market, the following types can be distinguished:

The 9 mm RA cartridge is the most common cartridge, also because it is used in the MP-79-9TM. Its main drawback is a very light bullet of 0.7 -1 grams. This cartridge is produced by Tekhkrim, KSPZ, AKBS, Oil Refinery and KHZ;

The 380 ME GUM cartridge is used in revolvers; its power is significantly inferior to its pistol counterparts due to the fact that revolvers are structurally weaker and the use of powerful ammunition will lead to the destruction of the weapon. This cartridge is produced by NSZ, Tekhkrim and AKBS;

  • The 10x22T cartridge is also widely used, like the 9 mm RA. It has good efficiency, especially if you do not use it on Umarex pistols, since they are not designed for its energy and quickly fail. Produced by Refinery, Tekhkrim, AKBS, Fiocchi;
  • The 10x28 cartridge is relatively new for the Russian market, used only in the Grand Power T12, Steyr M-A1 and TT-T. Produced by only one company, AKBS. Due to its high power, it can be used in service weapons, where legislative restrictions on muzzle energy are not so stringent;
  • 10x32T and 10x32TM cartridges are used in the Leader pistols and the Naganych revolver. A special feature of this ammunition is that it uses 2 propellant elements;
  • cartridge 11.43x32T is one of the best in its class;

The 18x45 cartridge is used in the Osa PBA, and is the oldest cartridge on the market, and yet its effectiveness is not disputed by anyone.

Obtaining permission to carry and store weapons

To obtain permission, you must first undergo a medical examination and obtain a certificate in form 046-1. Then you need to provide the following to the OLRR:

  • statement;
  • copy of passport;
  • received medical certificate;
  • 2 photographs 3x4 cm.
